Issuing a WoEF is not PEW

Interesting article in this months ElectroLink regarding a prosecution of an Electrical Inspector issuing a WoEF for a caravan for failing to pick up the wrong type of RCD was fitted.
EWRB prosecuted him saying issuing a WoEF falls under the definition of PEW,therefore they can prosecute him.
Appears they may have got this wrong?

Yes, they got it wrong.
Again.

Detailed explanation can wait; but suffice to say that their classification of it as maintenance is fundamentally flawed, ;
and appears to have been made principally so that they could apply disciplinary provisions (which can only apply to people doing PEW).
If it's not PEW, the Board simply doesn't have jurisdiction ; though ES would be able to prosecute.

Not surprising that the Board sometimes make errors of interpretation; even the members that are eligible to hold a PL can't be expected to be any better at knowing / understanding the rules than the rest of the trade (which they are there to represent).
